Amendment of section 23

Section 23 of the principal Act is amended —

(a)

by inserting, immediately after the words “residential property” in subsection (1)(a) and (b), the words “that is not non-restricted residential property”; and

(b)

by inserting, immediately after subsection (3), the following subsections:“(4) Any person who contravenes subsection (1)(a) or (b) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $50,000 or to imprisonment for a term not exceeding 3 years or to both.(5) The court shall, in respect of any defendant charged with committing any offence under subsection (1)(a) or (b) —

(a)

take into account any confiscation order made under section 23A before imposing any fine on the defendant; and

(b)

subject to paragraph (a), leave the confiscation order out of account in determining the appropriate sentence or other manner of dealing with the defendant.”.
