Clause 19

by deleting the word “and” at the end of subsection (3)(a);

by deleting the full-stop at the end of paragraph (b) of subsection (3) and substituting the word “; and”, and by inserting immediately thereafter the following paragraph:“(c)the award of costs and expenses of and incidental to any proceedings before the Appeal Panel.”; and

by inserting, immediately after subsection (9), the following subsection:“(9A) An Appeal Panel established by the Minister to consider and determine an appeal under section 98(2) may determine the appeal by confirming, varying or reversing any decision or direction of the Authority or by amending any code of practice or standard of performance issued or approved by the Authority, and the decision of the Appeal Panel shall be final.”.
