Amendment of section 78
Section 78 of the Gas Act is amended by inserting, immediately after subsection (5), the following subsection:“(5A) An appeal under subsection (5) shall not suspend the effect of a decision or direction to which the appeal relates unless —
(a)
otherwise allowed by the Minister; or
(b)
the appeal is against the imposition or the amount of a financial penalty.”.
