Clause 76

Related amendments to Medicines Act

The Medicines Act (Cap. 176) is amended —

(a)

by deleting the word “and” at the end of section 12(1)(b);

(b)

by deleting the full-stop at the end of paragraph (c) of section 12(1) and substituting the word “; and”, and by inserting immediately thereafter the following paragraph:“(d)whether the grant of a product licence for the medicinal products to which the application relates will be in the public interest.”; and

(c)

by inserting, immediately after section 76, the following section:“Act not to apply to products categorised and regulated as health products under Health Products Act 200777.—

(1)

Where any product to which this Act applies has been categorised as a type of health product under the Health Products Act 2007, the Minister may, by order published in the Gazette, declare that the provisions of this Act shall cease to apply to that type of product as from the date specified in the order, and the provisions of this Act shall, as from the date so specified, cease to apply to that type of product.(2) The Minister may, in making any order under subsection (1), prescribe such transitional, savings and other consequential provisions as he may consider necessary or expedient.”.
