Clause 13

Amendment of section 116

Section 116 of the principal Act is amended —

(a)

by deleting the words “without the written approval of the Minister” in subsection (1) and substituting the words “except under, and in accordance with the conditions of, a permit granted by the Deputy Commissioner of Police”;

(b)

by deleting subsections (2) to (6) and substituting the following subsections:“(2) An application for a permit referred to in subsection (1) shall —

(a)

be made to the Deputy Commissioner of Police in such form or manner, and not less than such period before the date of the competition or trial of speed, as the Deputy Commissioner of Police may require; and

(b)

be accompanied by such fee (if any) as the Minister may prescribe.(3) Upon receiving an application under subsection (2), the Deputy Commissioner of Police may —

(a)

grant the permit applied for —

(i)

in such form and manner as the Deputy Commissioner of Police may determine; and

(ii)

subject to such conditions as the Deputy Commissioner of Police thinks fit to impose; or

(b)

refuse to grant the permit.”; and

(c)

by deleting the words “without the written approval of the Minister” in subsections (7) and (8) and substituting in each case the words “that is in contravention of subsection (1)”.
