Clause 38

Appointment of Complaints Panel

(1)

For the purpose of enabling Complaints Committees and Disciplinary Tribunals to be constituted in accordance with this Part, the Council shall appoint a panel (referred to in this Act as the Complaints Panel) consisting of —

(a)

a Chairman and one or more Deputy Chairmen, from among the members of the Council;

(b)

not less than 10 and not more than 100 members, who are registered allied health professionals each of whom has at least 10 years’ experience in the practice of a prescribed allied health profession and who is not a member of the Council; and

(c)

not less than 6 and not more than 50 members, who are lay persons nominated by the Minister.

(2)

The term of office of a member of the Complaints Panel referred to in subsection (1)(a) shall expire at the end of his term of office as member of the Council.

(3)

The term of office of a member of the Complaints Panel referred to in subsection (1)(b) or (c) shall be determined by the Council and shall not exceed 2 years; and any such member shall be eligible for reappointment.

(4)

The Council may at any time remove from office any member of the Complaints Panel referred to in subsection (1)(a), (b) or (c) or fill any vacancy in its membership.

(5)

Any member of the Complaints Panel who is employed in the Ministry of Health shall not be disqualified from being a member of any Complaints Committee, Disciplinary Tribunal, Health Committee or Interim Orders Committee by reason only that he is so employed.
