Amendment of section 28
Section 28 of the principal Act is amended by deleting subsection (1) and substituting the following subsection:“(1) The Council may apply to a Judge by originating summons for an order directing the Registrar to cancel a practising certificate issued to a solicitor, if it appears to the Council that —
(a)
the certificate has been issued to the solicitor contrary to the provisions of this Act;
(b)
the accountant’s report submitted by the solicitor does not comply with section 73; or
(c)
the certificate has ceased to be in force under section 26(9)(a) or (b), but the solicitor has failed to notify the Registrar and the Council of this in accordance with section 27(3).”.
