Amendment of section 10
Section 10 of the principal Act is amended —
by deleting subsections (1), (2) and (3) and substituting the following subsections:“(1) No foreigner shall be a self-employed foreigner unless he has a valid work pass.(2) Any person who contravenes subsection (1) shall be guilty of an offence and shall —
be liable on conviction to a fine not exceeding $20,000 or to imprisonment for a term not exceeding 2 years or to both; and
on a second or subsequent conviction, be punished with imprisonment for a term of not less than one month and not more than 2 years and also be liable to a fine not exceeding $20,000.”;
by deleting paragraph (a) of subsection (4); and
by inserting, immediately after the words “1st July 2007” in subsection (4)(b), the words “or section 10(1) of this Act in force immediately before the date of commencement of section 7(a) of the Employment of Foreign Manpower (Amendment) Act 2012”.
