Clause 39
Application for registration of geographical indications
(1)
An application for registration of a geographical indication shall be made to the Registrar in the prescribed manner and shall specify —
the name, address and nationality of the applicant;
the capacity in which the applicant is applying for registration;
the geographical indication for which registration is sought;
the geographical area to which the geographical indication applies;
the goods to which the geographical indication applies;
the quality, reputation or other characteristic of the goods and how that quality, reputation or other characteristic (as the case may be) is essentially attributable to the place from which the goods originate;
where the geographical indication for which registration is sought relates to a qualifying country other than Singapore, evidence that the geographical indication has obtained recognition or registration as a geographical indication in the qualifying country of origin, where applicable; and
such other particulars as may be prescribed.
(2)
The application shall be subject to the payment of the application fee and such other fees as may be appropriate.
(3)
The Registrar shall not accept an application unless —
all the requirements under subsection (1) are satisfied;
all the fees payable under subsection (2) are paid; and
the applicant is entitled, under section 38, to file an application for registration of a geographical indication.
