Clause 49

Consequential and related amendments to Administration of Muslim Law Act

Section 53 of the Administration of Muslim Law Act (Cap. 3, 2009 Ed.) is amended —

(a)

by deleting the words “District Court” wherever they appear in subsections (1), (2), (3), (4) and (6) and substituting in each case the words “Family Court”;

(b)

by deleting subsection (5) and substituting the following subsection:“(5) In enforcing a custody order under subsection (2), a Family Court may exercise the powers conferred by section 14 of the Guardianship of Infants Act (Cap. 122).”; and

(c)

by inserting, immediately after subsection (6), the following subsections:“(7) The Family Justice Rules Committee constituted under section 46(1) of the Family Justice Act 2014 may make Family Justice Rules —

(a)

to regulate and prescribe the procedure and practice to be followed in any proceedings commenced in a Family Court pursuant to subsection (1) or (2); and

(b)

to provide for any matter relating to any such procedure or practice.(8) The Family Justice Rules may, instead of providing for any matter, refer to any provision made or to be made about that matter by practice directions issued for the time being by the registrar of the Family Justice Courts.”.
