New section 409C

Part XII of the Companies Act is amended by inserting, immediately before section 410 in Division 3, the following section:“Appeal409C.—

(1)

Any party aggrieved by an act or a decision of the Registrar under this Act may, within 28 days after the date of the act or decision, appeal to the Court against the act or decision.(2) The Court may confirm the act or decision or give such directions in the matter as seem proper or otherwise determine the matter.(3) This section shall not apply to any act or decision of the Registrar —

(a)

in respect of which any provision in the nature of an appeal or a review is expressly provided in this Act; or

(b)

which is declared by this Act to be conclusive or final or is embodied in any document declared by this Act to be conclusive evidence of any act, matter or thing.”.
