Amendment of section 33
Section 33 of the Companies Act is amended —
(a)
by deleting subsection (2) and substituting the following subsection:“(2) Where a company proposes to alter its constitution, with respect to the objects of the company, it shall give 21 days’ written notice by post or by electronic communications in accordance with section 387A or 387C, specifying the intention to propose the resolution as a special resolution and to submit it for passing at a meeting of the company to be held on a day specified in the notice.”; and
(b)
by deleting the words “issued share capital” in subsection (5A) and substituting the words “issued shares”.
