Clause 13

Amendment of section 42

Section 42 of the principal Act is amended —

(a)

by deleting the words “shall be guilty of an offence and” in subsection (1);

(b)

by deleting the words “and shall be liable on conviction to a fine not exceeding $1,000 and, in the case of a second or subsequent conviction, to a fine not exceeding $4,000 or to imprisonment for a term not exceeding 3 months or to both” in subsection (1); and

(c)

by deleting the words “under subsection (1)” in subsections (14), (17) and (18) and substituting in each case the words “under section 41A(1)”.
