Clause 6

Amendment of section 19

Section 19 of the principal Act is amended —

(a)

by deleting the words “the person who was driving the motor vehicle at or about the time of the alleged offence” in subsection (3)(b)(i) and substituting the words “the person who, at or about the time of the alleged offence, was the driver of the motor vehicle”;

(b)

by inserting, immediately after the words “in charge or in control of the motor vehicle” in subsection (3)(b)(ii), the words “at or about the time of the alleged offence”; and

(c)

by deleting subsection (4) and substituting the following subsections:“(4) Any person who, without reasonable excuse, fails to comply with subsection (3)(b) within 14 days after the date on which the information was required from him shall be guilty of an offence.(5) A person is not excused from giving any information required of him by subsection (3)(b) on the ground that the disclosure of the information might tend to incriminate the person.”.
