Clause 12

by deleting subsection (1) and substituting the following subsections:“(1) An authorised officer, a police officer or an officer of customs may arrest without warrant any person whom the officer reasonably suspects of committing or attempting to commit an offence under this Act.(1A) The officer making an arrest under this section must not restrain the person arrested more than is necessary to prevent the person’s escape.”; and

by inserting, immediately after subsection (2), the following subsection:“(2A) A person who is arrested under this section must not be detained in custody for a period longer than is reasonable under the circumstances of the case, and such period must not exceed 48 hours (excluding the time necessary for the journey to a Magistrate’s Court).”.
