Clause 43

Waiver certificate

(1)

The Minister may, on the application of a person —

(a)

grant a waiver certificate, with or without conditions, waiving the application of all or any of the requirements of this Act as they concern the person, for such period as the Minister may specify;

(b)

add to, vary or cancel any condition of such waiver; or

(c)

extend the period of such waiver.

(2)

The Minister may require a person granted a waiver certificate under subsection (1)(a) to pay a fee for the purpose of recovering the costs of regulating the person’s compliance with the conditions of the waiver.

(3)

A waiver certificate granted under subsection (1)(a) need not be published in the Gazette.

(4)

An application under this section —

(a)

must be made in such form as the Registrar may specify;

(b)

must include such information as the Registrar may require in any case; and

(c)

must be accompanied by the payment of the prescribed fee.
