Amendment of section 58
Section 58 of the principal Act is amended —
by deleting subsection (2) and substituting the following subsections:“(2) The Board may apply to the Registrar of the Supreme Court for an order to deposit the compensation in court where —
any person entitled to the compensation refuses to accept it or cannot with due diligence be found;
there is any dispute as to the entitlement to or the apportionment of the compensation;
the Board is satisfied that any person entitled to the compensation is incapacitated by reason of mental illness and no donee of a lasting power of attorney or deputy has been appointed under the Mental Capacity Act (Cap. 177A); or
the person entitled to the compensation is deceased and no legal personal representative has been appointed.(2A) An application under subsection (2) is to be made ex parte by originating summons, supported by an affidavit.(2B) Despite anything to the contrary in the Rules of Court, the Registrar of the Supreme Court may make an order under subsection (2) to deposit the compensation in court.”; and
by inserting, immediately after subsection (3), the following subsection:“(4) Any reference to compensation in subsections (2) and (2B) includes a reference to any part of the compensation.”.
