Clause 11

Obtaining benefit through false or misleading statements, etc.

(1)

A person —

(a)

who —

(i)

knowingly or recklessly makes any false or misleading statement; or

(ii)

produces or furnishes, or causes to be produced or furnished, any document which the person knows, or ought reasonably to know, is false in a material particular; and

(b)

who, with the intention of dishonestly inducing another person to accept the statement or document as genuine, dishonestly obtains any cash grant or other benefit under the Scheme,shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 12 months or to both.

(2)

Subsection (1) is without prejudice to any right of recovery under section 10.
