Clause 43

Prohibiting person from conducting research or tissue banking activities

(1)

The Director may, by order published in the Gazette, prohibit any person from conducting any, all or specified types of human biomedical research or tissue banking activities, as the case may be, if —

(a)

the person has been convicted of an offence under this Act;

(b)

the person has been convicted in Singapore or elsewhere of any offence involving fraud, dishonesty or moral turpitude; (c)the Director is satisfied that the person is not of good reputation or character, or is otherwise unfit to conduct human biomedical research or tissue banking activities, as the case may be; or

(d)

for medical reasons, the person is unable to perform his or her duties as a researcher, as assessed by a medical practitioner.

(2)

Any person who conducts human biomedical research or tissue banking activity in contravention of a prohibition order made under subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $100,000 or to imprisonment for a term not exceeding 10 years or to both.
