Amendment of section 90
Section 90 of the principal Act is amended by inserting, immediately after subsection (11), the following subsection:“(12) The Minister may designate any of the following to hear and determine, in the Minister’s place, any appeals or a specific appeal under this section:
(a)
any Minister of State or Parliamentary Secretary for the Minister’s Ministry; (b)any public officer in that Ministry not subordinate to the decision-maker whose decision is appealed against,and any reference in this section to the Minister includes a reference to the Minister of State, Parliamentary Secretary or public officer so designated for that appeal.”.
