Amendment of section 23

Section 23 of the principal Act is amended —

(a)

by deleting subsection (1) and substituting the following subsections:“(1) If a police officer or an authorised officer reasonably suspects that a person has committed or is committing an offence under this Act, the officer may do all or any of the following:

(a)

require the person to furnish evidence of the person’s identity;

(b)

search any bag or thing belonging to or in the possession of the person;

(c)

require the person to reveal the contents of the person’s pockets, if any;

(d)

arrest the person without warrant.(1A) Any person arrested under subsection (1)(d) must be produced before a Magistrate’s Court or a District Court (called in this section a Court) within 48 hours after the person is arrested.”; and

(b)

by deleting subsection (3).
