Amendment of Settled Estates Act
Section 16(2) of the Settled Estates Act (Cap. 293, 2013 Ed.) is amended by deleting paragraph (c) and substituting the following paragraph:“(c)either of the following persons, on behalf of an individual who lacks capacity within the meaning of the Mental Capacity Act (Cap. 177A):
a donee of a lasting power of attorney which is granted by that individual under the Mental Capacity Act, and under which that individual confers on the donee authority to make decisions in relation to that individual for the purposes of this Act;
a deputy who is appointed or deemed to be appointed for that individual by the court under the Mental Capacity Act, and who is conferred power to make decisions in relation to that individual for the purposes of this Act.”.
