Clause 4

Amendment of Conveyancing and Law of Property Act

The Conveyancing and Law of Property Act (Cap. 61, 1994 Ed.) is amended —

(a)

by deleting subsection (5) of section 7 and substituting the following subsection:“(5) A person is deemed to be expressed to convey in a fiduciary capacity if the person is expressed to convey —

(a)

as a trustee or mortgagee;

(b)

as a personal representative of a deceased person;

(c)

as a donee of a lasting power of attorney granted under the Mental Capacity Act (Cap. 177A);

(d)

as a deputy appointed or deemed to be appointed by the court under the Mental Capacity Act; or

(e)

under an order of court.”; and

(b)

by deleting the words “Mental Capacity Act 2008” in sections 46(3), 47(4) and 48(11) and substituting in each case the words “Mental Capacity Act (Cap. 177A)”.
