Clause 6

Amendment of Evidence Act

The Evidence Act (Cap. 97, 1997 Ed.) is amended —

(a)

by inserting, immediately after the definition of “copy of a document” in section 3(1), the following definition:“ “country” includes a territory;”;

(b)

by deleting the word “territory” wherever it appears in sections 59(1)(b) and (d) and 80(2) and (3) and substituting in each case the word “country”;

(c)

by deleting the word “territories” in section 59(1)(j) and substituting the word “countries”; and

(d)

by repealing section 86 and substituting the following section:“Presumption as to publication containing law or report of court decision

86. The court is to presume the genuineness of every publication purporting —

(a)

to be printed or published under the authority of the government of any country and to contain any law of that country; or

(b)

to contain any official or authoritative report of a decision of a court of any country.”.
