Clause 16

Report in good faith made to Chief Justice, police, etc., not contempt

(1)

To avoid doubt, a person is not guilty of contempt of court under section 3(1)(a) by reason that he or she has made a report to the Chief Justice, the police, a law enforcement agency or any other public authority alleging misconduct or corruption on the part of a judge, being a report —

(a)

which is made in good faith; and

(b)

which discloses grounds which, if unrebutted, would provide a sufficient basis for the investigation of the allegation of misconduct or corruption.

(2)

In this section, “law enforcement agency” has the same meaning as in the Criminal Procedure Code (Cap. 68).
