Clause 31

Amendment of section 42

Section 42 of the principal Act is amended —

(a)

by inserting, immediately after the words “subsection (2)” in subsection (4), the words “but without prejudice to section 43A”; and

(b)

by inserting, immediately after subsection (5), the following subsection:“(6) The Board or an appointed insurer, as the case may be, may, in such circumstances as may be prescribed by regulations made under this Part —

(a)

refuse to insure, under the Scheme, any person who has made an application under subsection (4);

(b)

insure a person under the Scheme subject to such terms and conditions as the Board or appointed insurer may impose either generally or in a particular case; or

(c)

continue to insure a person referred to in section 43(1), subject to such terms and conditions as the Board or appointed insurer may impose either generally or in a particular case.”.
