Clause 36

Amendment of section 146

Section 146 of the Women’s Charter is amended —

(a)

by inserting, immediately after the words “another person” in subsection (1), the words “(being a woman or girl)”;

(b)

by deleting the words “be liable on conviction to imprisonment” in subsection (1) and substituting the words “on conviction be punished with imprisonment”;

(c)

by inserting, immediately after subsection (1), the following subsection:“(1A) Any person who knowingly solicits, receives or agrees to receive any gratification as an inducement or reward for providing any service, and who by providing that service does or will aid the prostitution of another person (being a woman or girl), shall be guilty of an offence and shall on conviction be punished with imprisonment for a term not exceeding 5 years and shall also be liable to a fine not exceeding $10,000.”;

(d)

by inserting, immediately after subsection (3), the following subsection:“(4) In this section, “gratification” includes —

(a)

money or any gift, loan, fee, reward, commission, valuable security or other property or interest in property of any description, whether movable or immovable;

(b)

any office, employment or contract;

(c)

any payment, release, discharge or liquidation of any loan, obligation or other liability whatsoever, whether in whole or in part; and

(d)

any other service, favour or advantage of any description whatsoever.”; and

(e)

by inserting, immediately after the word “prostitution” in the section heading, the word “, etc.”.
