Amendment of section 164
Section 164 of the Women’s Charter is amended —
by deleting the words “156, 159 or 160” in subsection (1) and substituting the words “156 or 159”;
by deleting subsection (2) and substituting the following subsections:“(2) Where an order has been made under section 160 for the detention of a woman or girl in a place of safety, and it appears to the Director that the taking of one of the following courses of action is expedient in the interests of the woman or girl, the Director may order the taking of that course of action:
the transfer of the woman or girl from that place of safety to another place of safety within Singapore;
the discharge of the woman or girl from that place of safety, and the commitment of the woman or girl to the care of a fit individual.(3) Where an order has been made under section 160 for the commitment of a woman or girl to the care of a fit individual, and it appears to the Director that the taking of one of the following courses of action is expedient in the interests of the woman or girl, the Director may order the taking of that course of action:
the transfer of the woman or girl from the care of that fit individual to the care of another fit individual;
the withdrawal of the woman or girl from the care of that fit individual, and the detention of the woman or girl in a place of safety within Singapore.(4) Where a woman or girl is detained in a place of safety in Singapore on the request in writing of her lawful guardian under section 160(1)(a), she must not be transferred or discharged from that place of safety under subsection (2), unless her lawful guardian has given approval in writing for that transfer or discharge.(5) Where a woman or girl is committed to the care of a fit individual on the request in writing of her lawful guardian under section 160(1)(a), she must not be transferred or withdrawn from the care of that fit individual under subsection (3), unless her lawful guardian has given approval in writing for that transfer or withdrawal.”; and
by inserting, immediately after the words “within Singapore” in the section heading, the word “, etc.”.
