Clause 57

by deleting subsection (1) and substituting the following subsection:“(1) The Commissioner may, in his discretion, compound any offence under this Act that is prescribed as a compoundable offence by collecting from a person reasonably suspected of having committed the offence a sum not exceeding the lower of the following amounts:

one half of the amount of the maximum fine that is prescribed for the offence;

$5,000.”;

by deleting the words “to the Building and Construction Authority” in subsection (3) and substituting the words “into the Consolidated Fund”; and

by inserting, immediately after subsection (3), the following subsection:“(4) The Commissioner, and any other officer appointed under section 3(3) to exercise the powers conferred on the Commissioner under this section, are, in relation to the administration, collection and enforcement of payment of composition sums under this section, each taken to be a public officer for the purposes of the Financial Procedure Act (Cap. 109); and section 20 of that Act applies to the Commissioner and other officer even though he is not or was not in the employment of the Government.”.
