Clause 12

Amendment of section 22

Section 22 of the Planning Act is amended —

(a)

by inserting, immediately after subsection (1), the following subsection:“(1A) Where the competent authority cancels a planning permission or conservation permission under section 15(4), any person aggrieved by that decision may appeal to the Minister against that decision.”;

(b)

by inserting, immediately after subsection (2), the following subsection:“(2A) An appeal does not affect the enforceability of any condition imposed or prevent the taking of any action in respect of any unauthorised development of any land or any unauthorised works within a conservation area unless otherwise directed by the Minister in any particular case.”; and

(c)

by deleting the words “in addition to the conditions allowed by the Minister” in subsection (5) and substituting the words “whether the Minister dismisses or allows the appeal unconditionally or subject to conditions”.
