Clause 18

Section 37 of the Planning Act is amended by deleting subsection (2) and substituting the following subsections:“(2) Subject to subsection (2A), the liability of the person on whom the development charge is levied continues despite any change in ownership of the land.(2A) Where a person’s liability to pay development charge is deferred under the rules made under section 40(1)(d), the person may obtain the Minister’s written approval for the person’s liability to end upon a change in ownership of the land.”.
