Amendment of section 13
Section 13 of the Planning Act is amended by inserting, immediately after subsection (1), the following subsections:“(1A) Unless otherwise prescribed, a person applying for —
planning permission for any development of any land must, before the person makes the application, appoint an architect or engineer to carry out the duties specified in section 24A; or
conservation permission for any works within a conservation area must, before the person makes the application, appoint an architect to carry out the duties specified in section 24A.(1B) Where the qualified person appointed under subsection (1A) ceases to be appointed for any reason, the developer must —
without delay appoint another qualified person in accordance with subsection (1A); and
within 7 days after the appointment under paragraph (a), notify the competent authority of that appointment.(1C) A developer who, without reasonable excuse, fails to comply with subsection (1B)(b) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000.”.
