Amendment of section 45

Section 45 of the principal Act is amended —

(a)

by deleting the words “section 46(13)” in subsection (1) and substituting the words “sections 10J and 46(13)”; and

(b)

by inserting, immediately after subsection (2), the following subsection:“(3) The Minister may designate to hear and determine, in his place, any appeals or a specific appeal under this section —

(a)

any Senior Minister of State or Minister of State, or Senior Parliamentary Secretary or Parliamentary Secretary, for his Ministry; or (b)any public officer in his Ministry not subordinate to the person whose decision is appealed against,and any reference in this section to the Minister includes a reference to the Senior Minister of State or Minister of State, or Senior Parliamentary Secretary or Parliamentary Secretary or public officer so designated for that appeal.”.
