Repeal and re-enactment of section 35
Section 35 of the principal Act is repealed and the following section substituted therefor:“Accounts and records35.—
Every Town Council has a duty to ensure that there are kept in accordance with the Financial Rules —
proper accounts and records of the transactions and affairs of the Town Council; and
proper and separate accounts for each of the funds established under section 33(1), (4) and (4A).(2) A Town Council has a duty to do all things necessary to —
ensure that all money payable to the Town Council is properly collected;
ensure that appropriate arrangements are implemented for the security of all money received by the Town Council;
ensure that all money expended by the Town Council is correctly spent and properly authorised;
ensure that adequate control is maintained over assets owned by or in the custody or control of the Town Council;
ensure that all liabilities incurred by the Town Council are properly authorised; and
ensure that its accounts and records are kept up‑to‑date and ready for inspection at any time by its auditor, an inspector or any other person authorised by or under this Act or any other written law to inspect those accounts and records.”.
