Clause 9

Repeal and re-enactment of section 8

Section 8 of the Films Act is repealed and the following section substituted therefor:“Security8.—

(1)

The Authority may, upon granting a licence, require the licensee to give a performance bond, guarantee or other form of security on such terms and conditions and of such amount as the Authority considers appropriate —

(a)

to ensure that the provisions of this Act and its subsidiary legislation, and the conditions of the licence, will be duly observed; and

(b)

to meet any financial penalty arising out of any proceedings under section 11 against the licensee.(2) If a licensee fails to pay any financial penalty ordered under section 11, the Authority may enforce the payment by forfeiting the whole or any part of any deposit placed by the licensee under this section.(3) This section does not affect the operation of section 11.”.
