Power to require information in respect of contraventions
(1)
Where it appears to an authorised officer that there may have been a contravention of any provision of this Act, the authorised officer may serve an information notice to require any person who appears to the authorised officer to be acquainted with the circumstances of the case to furnish the authorised officer, within such time as may be specified in the notice, with information relating to that case which is in the possession or within the knowledge of that person.
(2)
An information notice under subsection (1) is complied with by giving the required information in writing to the authorised officer.
(3)
A person who fails to comply with any information notice under subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000.
(4)
If any person —
makes any statement purporting to comply with a requirement of an information notice which the person knows to be false or misleading in a material particular; or
recklessly makes such a statement which is false or misleading in a material particular,that person shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000.
