Amendment of section 95

Section 95 of the Code is amended —

(a)

by deleting paragraph (b) of subsection (1) and substituting the following paragraph:“(b)the accused is accused of any non‑bailable offence, and the court believes, on any ground prescribed in the Criminal Procedure Rules, that the accused, if released, will not surrender to custody, be available for investigations or attend court; or”;

(b)

by deleting the word “or” at the end of subsection (2)(a); and

(c)

by deleting the full‑stop at the end of paragraph (b) of subsection (2) and substituting the word “; or”, and by inserting immediately thereafter the following paragraph:“(c)release on bail an accused who has been arrested or taken into custody under a warrant mentioned in subsection (1)(c), if the conditions prescribed in the Criminal Procedure Rules for such release are satisfied.”.
