Clause 23

Amendment of section 46

Section 46 of the Active Mobility Act 2017 is amended —

(a)

by deleting the words “a footpath or shared path” in subsection (1) and substituting the words “, or is causing inconvenience to the exercise of any right by any person under section 12 or 13 on, a public path”;

(b)

by inserting, immediately after the words “an authorised officer” in subsections (1), (3), (4) and (6), the words “, an outsourced enforcement officer”;

(c)

by inserting, immediately after the words “an obstruction” in subsection (1), the words “or inconvenience”;

(d)

by inserting, immediately after the words “An authorised officer” in subsection (2), the words “, an outsourced enforcement officer”; and

(e)

by inserting, immediately after the words “the authorised officer” in subsection (6), the words “, outsourced enforcement officer”.
