Clause 69

Amendment of section 136

Section 136 of the Road Traffic Act is amended —

(a)

by deleting subsection (2) and substituting the following subsections:“(2) Where a person pays by cheque the whole or any part of any tax or fee for a licence under this Act or any subsidiary legislation made under the Act, and the cheque is not accepted on presentation or is dishonoured —

(a)

the licence is void as from the date when it was granted or renewed, as the case may be; and

(b)

the Registrar must give the person a dishonour notice in a manner allowed under section 131A.(2A) A dishonour notice must —

(a)

contain a statement to the effect that the cheque was dishonoured or not accepted, as the case may be;

(b)

contain a statement to the effect that the relevant licence is void as from the date when it was granted or renewed, as the case may be; and

(c)

if the licence was not issued in electronic form, require the person to deliver up the licence to the Registrar within a period of 7 days after the date that the dishonour notice is given.”;

(b)

by deleting the words “subsection (2)” in subsection (3) and substituting the words “subsection (2A)(c)”; and

(c)

by deleting the words “the notice under subsection (2) is posted” in subsection (4) and substituting the words “the dishonour notice is given”.
