Clause 430
Formal defect not to invalidate proceedings or acts
(1)
No proceedings in bankruptcy are invalidated by any formal defect or by any irregularity, unless the Court before which an objection is made to the proceedings is of the opinion that substantial injustice has been caused by the defect or irregularity and that the injustice cannot be remedied by any order of the Court.
(2)
The acts of a person as a trustee or as a special manager, and the acts of the creditors’ committee appointed for any bankruptcy, are valid despite any defect in the appointment, election or qualifications of the trustee, manager or any member of the committee, as the case may be.
