Amendment of section 39
Section 39 of the CDS Act is amended by deleting subsection (2) and substituting the following subsection:“(2) Any person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction —
(a)
if the person is an individual, to a fine not exceeding $250,000 or to imprisonment for a term not exceeding 3 years or to both; or
(b)
if the person is not an individual, to a fine not exceeding $500,000.”.
