Insurer not to object on ground of double insurance
(1)
In any proceedings under Part 4, an employer’s insurer is not entitled to raise any objection or defence to a claim on the ground that there is in force another insurance policy issued by another insurer covering the same liability under this Act in respect of the claim as the insurance policy issued by the employer’s insurer.
(2)
Nothing in subsection (1) affects any other law —
(a)
on double insurance and contribution; or (b)that prohibits an insurer from disproving liability, in whole or in part, in respect of any accident.
