Clause 66

Depositions admissible under Merchant Shipping Act

(1)

Where an injured seafarer is discharged or left behind in any territory in the Commonwealth or in a foreign country, depositions about the circumstances and nature of the injury may be taken by —

(a)

any judge or magistrate in that territory; or (b)a consular officer in the foreign country.

(2)

Where any deposition is taken in accordance with subsection (1) and transmitted to the Minister by the person who took the deposition, the deposition or certified copies thereof are admissible in evidence in any proceedings for compensation under this Act, as provided by sections 184 and 186 of the Merchant Shipping Act, and those sections apply accordingly.
