Clause 79

The Minister may, by order in the Gazette and with or without conditions, exempt any class or description of persons from all or any of the provisions of this Act.

If a person fails to comply with a condition of an exemption, the exemption does not, while the non‑compliance continues, operate in that person’s favour.

If, by virtue of subsection (2), a person is guilty of an offence under a provision of this Act from which the person was exempted by an exemption, the person may be proceeded against for that offence.
