Clause 5

by deleting the words “An individual” in subsections (1) and (2) and substituting in each case the words “A person”;

by inserting, immediately after subsection (1), the following subsection:“(1A) Subsection (1) applies only where no other provision of this Act creates an offence in connection with the provision of information that is false or misleading in a material particular.”; and

by deleting subsection (3) and substituting the following subsection:“(3) A person who contravenes subsection (1) or (2) shall be guilty of an offence and shall be liable on conviction —

in the case of an individual, to a fine not exceeding $50,000 or to imprisonment for a term not exceeding 2 years or to both; or

in any other case, to a fine not exceeding $100,000.”.
