Unauthorised manufacture, etc., of weapons
(1)
A person commits an offence if —
the person manufactures or takes part in the manufacture, or disposes of, any object or thing;
the object or thing is a weapon or noxious substance;
the person knows that or is reckless as to whether the object or thing is a weapon or noxious substance; and
the person is not one of the following:
a person granted a licence to manufacture or dispose of the weapon or noxious substance;
a class licensee authorised under a class licence to manufacture or dispose of the weapon or noxious substance; (iii)a person exempt from this section under section 87, 88 or 89 in relation to the manufacture or disposal of the weapon or noxious substance.
(2)
A person commits an offence if —
the person repairs or takes part in the repair of any object or thing;
the object or thing is a weapon;
the person knows that or is reckless as to whether the object or thing is a weapon; and
the person is not one of the following:
a person granted a licence to repair the weapon;
a class licensee authorised under a class licence to repair the weapon; (iii)a person exempt from this section under section 87, 88 or 89 in relation to the repair of the weapon.
(3)
To avoid doubt, subsections (1) and (2) apply to a person regardless that the weapon or noxious substance concerned was manufactured, disposed of or repaired other than in the course of carrying on a business.
