Amendment of section 12
Section 12 of the principal Act is amended —
(a)
by deleting the words “Part I or II” in subsections (6) and (7) and substituting in each case the words “Part 1 or 2”; and
(b)
by deleting subsection (9) and substituting the following subsection:“(9) To avoid doubt, an instrument used to create a lasting power of attorney —
(a)
may itself appoint one or more replacement donees in respect of a particular donee; but(b)cannot itself appoint a person to replace any replacement donee.”.
