Clause 185

Permitted uses may go beyond scope of copyright or protection of performances

An act that is a permitted use —

(a)

is not necessarily comprised in a copyright; and

(b)

would not necessarily constitute an infringing use of a protected performance if the act were not a permitted use.Explanation. — To provide certainty, some provisions on permitted uses are drafted in a way that goes beyond the acts comprised in a copyright and what would otherwise be an infringing use of a protected performance.
