Clause 61

What does communicate mean

(1)

“Communicate”, in relation to a work or performance, means to transmit the work or performance by electronic means, and includes —

(a)

broadcasting the work or performance;

(b)

the inclusion of the work or performance in a cable programme; and

(c)

making the work or performance available (on a network or otherwise) in way that it may be accessed by any person on demand.

(2)

For the purposes of subsection (1), it does not matter —

(a)

whether the transmission is over a path or a combination of paths;

(b)

whether the path or paths are provided by a material substance or by wireless means or otherwise; and

(c)

whether the work or performance is sent in response to a request.

(3)

“Communication” has a corresponding meaning.
