Clause 22

Amendment of section 17

Section 17 of the Plant Varieties Protection Act is amended —

(a)

by inserting, immediately after the words “candidate variety” in subsection (1)(b), the words “, but only if the Registrar or the Examiner requests for it”;

(b)

by inserting, immediately after subsection (2), the following subsection:“(2A) The Registrar or the Examiner may consider the information and materials lodged under section 18A by the applicant for the purpose of the examination.”; and

(c)

by inserting, immediately after subsection (4), the following subsection:“(5) The Registrar or the Examiner (as the case may be) may extend the period in subsection (4) in a particular case.”.
